PRIVATE USE INSTRUMENT, CONCESSION OF RIGHTS AND OTHER SETTLEMENTS

The utilization of this website, from now on named EcoBlogs Network, and you, named Participant, the fair and settled parts sign the present instrument that applies with the following rules and conditions:

CLAUSE FIRST – DEFINITIONS

1.1.The expressions below, when utilized in this private instrument of concession of rights and other settlements, will have the following meanings:
• • Terms of use: the present private instrument of concession of rights and other settlements.
• Use: sending of posts, evaluations and comments to be inserted in the site of the EcoBlogs Network.
• Posts: title, text, images, video and others.
• The EcoBlogs Network: gatherer site and library of posts about the environment, sustainability, recycling and conscious consumption.
• Identification: banner or widget identifying the EcoBlogs Network participants.
• Moderation: analysis through the EcoBlogs Network to approve or disapprove the posts.
• Approval: acceptance of the posts, evaluation and comments that may, up to the EcoBlogs Network, be freely edited.
• Disapproval: rejection of posts, up to the EcoBlogs Network.

CLAUSE SECOND – OBJECT

2.1. The object of these terms of use is the sending of the services, by the participant, to the EcoBlogs Network, in accordance with the instructions, determined by the EcoBlogs Network.

2.2. It is still object of the contract, the interruption and transfer, by the participant, to the EcoBlogs Network, of the totality of the royalties, of patrimonial nature, that is holder, incident on the use, in irrevocable and irretreatable character.

CLAUSE THIRD – PARTICIPANTS’ OBLIGATIONS

Are participants’ obligations, beyond the others previewed in the present in these terms of use:

(I) SENDING OF POSTS, EVALUATIONS AND COMMENTS
3.1.1. Do not publish, through the EcoBlogs Network, any slanderous, pornographic or other material that may violate or interfere in any way the rights of the third parties, or that may origin the civil and criminal and/or violate the law, in federal, statual or municipal;
3.1.2. Do not publish any material, protected by intellectual property rights and personality rights, including but not limiting to royalties, trademark rights, patent rights, image rights, sound and voice rights, without the express authorization, written, by the holder of the intellectual property rights, and personality rights.

(II) OF THE RIGHTS’ CLOSING AND TRANSFER

3.1.3. give, in totality, in every way, in total character, in order to use in any time, in Brazil and/or abroad, all patrimonial royalties, above every content or creative material published in the EcoBlogs Network;

3.1.4. allow the utilization through the EcoBlogs Network and through its supporter, the MAPFRE Foundation, in the way they find it suitable, the material, available for publishing in the EcoBlogs Network, but with its proper author’s identification;

(III) OF RESPONSIBILITY

3.1.5. treat exclusively with the EcoBlogs Network any subject related to the obligations of the Terms of Use, receiving, only from the EcoBlogs Network, or any who it indicates, the instructions to be followed;

3.1.6. maintain under its subordination and supervision, as well as remunerate, the people needed to the execution of the obligations of the Terms of Use, which will not maintain bonds, in any nature, with the participants;

3.1.7. exempt ad indemnify the EcoBlogs Network, the company that develops it and its supporter, the MAPFRE Foundation, of the responsibility on any complaint, loss, cost and expense resulting of the publishing in the EcoBlogs Network by the Participants, including, but not limiting, in any communication, by means of the Participants, that is declared slanderous, illegal or violation of intellectual property rights and personality rights, such as, royalties, patent rights, trademark rights, image rights, voice rights and others.

CLAUSE FORTH – FINAL DISPOSITIONS

4.1. Any alteration of the conditions anticipated here, should be stated of private instrument, that is member part of the terms of use;
4.2. The nullity of any item of the Terms of Use will not implicate in the nullity of the others, that are independent;
4.3. All the attachments, updates and instructions, given in the terms of use will be member parts of the terms of use;
4.4. the parts elect the forum of the city of São Paulo, to settle all of the questions came from the terms of use, resigning any other, as privileged as it is.

The use of the site implicates in the acceptance of the Terms of Use. And, because they are just and contracted, the parts when utilizing the site of the EcoBlogs Network, accept the Terms of Use.
